ToStatic Terms of Service

Welcome to ToStatic. These Terms of Service ("Terms") supersede all prior versions and govern your ongoing and future use of the ToStatic website, web application, browser extension (the "Extension"), and all related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
These terms govern the usage of our services and products across all verticals. Your continuous usage of our products/services binds you to abide by these terms and any revisions to them. We will publish timely updates, and inform you, if we have a means to do so.
By accessing or using the Service, whether through our website, social media, Chrome Web Store page, the Extension, or any third-party service integrated with ToStatic, you agree to be bound by these Terms and our separate Privacy Policy and Cancellation Policy. If you do not agree to these Terms, you may not use the Service.
1.1. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which covers the collection, use, and disclosure of your personal information, including, but not limited to, the use of your IP address to estimate your geo-location for purposes such as tracking, analytics, and service optimization. By accepting these Terms, you acknowledge and agree to the terms of the Privacy Policy as well.
1.2. Prohibited Use
You shall not use the Service to access, extract, or export content from any third-party website in a manner that violates the intellectual property rights, security, or Terms of Service of that third party.
ToStatic does not authorise, endorse, or encourage the use of its Service in violation of any third-party platform’s terms. Responsibility rests solely with the user.
2. The ToStatic Service and Channels
ToStatic provides users with a way to create lawful exports of the content that is publicly accessible from their own websites, similar to the manual ‘Save Page’ functionality provided by the browsers. ToStatic tries, to its best, to ensure that users only export the content they are creating by enforcing verifications in the steps of the processes.
2.1. Full Service Scope, Hosting, and Monitoring
ToStatic is not solely an export tool. The Service also includes additional offerings, such as website hosting (for both free and paid users), Free SSL certificates, domain management services (e.g., purchase or transfer), and other related tools, which may be added in the future.
Hosting & Integrations: Hosting services are provided via integrations with third-party platforms (including but not limited to bunny.net, Cloudflare, Netlify, and surge.sh). Your use of these integrated services is conditioned upon enabling the necessary integrations within the Service, which may require you to accept those third parties' terms.
Usage Monitoring: To ensure service stability and manage costs associated with bandwidth and server usage (including protection against sudden surges, attacks, or FUP violations), you acknowledge that ToStatic may monitor usage across its services and servers by injecting a small, non-obtrusive tracking script (via a network/fetch call to our API) into the code of all websites exported or hosted using the Service. This script is designed to track basic request data (e.g., incoming traffic volume and destination URL) and does not intentionally use cookies or collect any personal data beyond what is necessary to determine service usage and compliance with our FUP.
Free Services Disclaimer: Any free services, including hosting and SSL, are provided "AS IS," without any warranties or liability for damages or losses, and may contain defects or interruptions, or be discontinued or shut down without prior notice. Your continuous use of these services/features is at your own risk and ToStatic cannot be held liable for any damages or losses, whatsoever, arising out of any such cases.
2.2. Service Channels
You may access and interact with our Service through various channels and platforms:
Main Website: tostatic.com
Social Media: Facebook, LinkedIn, YouTube, and others (for promotional and informational content).
Chrome Web Store: For downloading and updating the Extension.
Extension Pages: The Popup and Sidebar Application within your browser.
2.3. Verification and Affiliation
ToStatic requires users to verify ownership or publishing rights for the websites they export. Manual Verification may include confirming the website URL within a user’s project page and checking platform-level permissions. Access-Based Verification (used by our import tool) relies on the user being actively logged into the source platform, which allows our tool to import only published projects. This process ensures that users only add projects they legally own and control. Access to the Service may be denied if verification cannot be established.
Moreover, ToStatic is an independent service and is not affiliated with, endorsed by, or connected to any third-party platform (including Wix, Webflow, Squarespace, Framer, etc.). The use of ToStatic does not imply any such relationship.
2.4. Operational Mechanics and Content Processing
You acknowledge that ToStatic operates as a specialized content processing and packaging utility designed to automate the export of your publicly accessible web pages. The specific methods used to identify, capture, and structure content are proprietary, but the general mechanisms and limitations are as follows:
A. Content Acquisition and Identification: ToStatic identifies and processes your content using a combination of methods:
Site Structure Analysis: Analyzing a website's published sitemap or identifying all available pages and links that belong to the same domain.
Code-Based Retrieval: Utilizing system tools and scripts to retrieve the final rendered content and code of the public pages you specify.
Platform Integration: Utilizing platform-specific API integrations (where previously authenticated by you) to generate content directly from the underlying platform data, rather than retrieving the publicly rendered page.
B. Processing and Limitations: ToStatic uses pre-processing to prepare pages for static export. The export process is intentionally limited and is subject to the following expectations:
Asset Exclusion: To reduce file size and avoid legal issues with third parties, ToStatic will exclude many external resources during the export. This includes, but is not limited to, CDN scripts, resources, icons, SVGs, media, and styles that are not native to the base HTML structure.
Output Integrity Risk: ToStatic may change file types or code structures to ensure compatibility with static hosting environments. This pre-processing may result in a broken or non-identical output page. ToStatic provides a preview URL for your final confirmation; the quality and functionality of the final exported content are your sole responsibility.
C. Content Rights and Data Handling:
Ownership: ToStatic does not claim or retain any copyright or intellectual property rights over the generated content, media, or assets exported by you.
Data Deletion: To protect your privacy and reduce data risk, files generated during the export process are automatically deleted from our servers within 10 minutes of generation.
Post-Processing: ToStatic may inject a small, non-obtrusive tracking code into the html of the exported site for the sole purpose of monitoring usage and FUP compliance, as detailed in Section 2.1.
D. User Responsibility: While ToStatic only retrieves assets relative to the verified URL, it remains the user's ultimate responsibility to ensure that all exported content and assets are owned by them or that the user has explicit, legal rights to possess and use the material.
3. License to Use Public Information and Content
3.1. Grant of License for Public Assets
You retain all ownership rights to the content you create, manage, or export using the Service ("User Content"). However, solely for the purpose of promoting the ToStatic Service, you hereby grant ToStatic a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and display the following assets that are publicly accessible and/or created, captured, or managed through the Service:
Website Logos, Favicons, and Site Icons: Assets extracted from the public websites you choose to interact with using the ToStatic Service.
Site Names and URLs: The names and public addresses of the websites.
Visual Representations: Non-sensitive, publicly available visual elements (e.g., screenshots of the public-facing site, but not of your private dashboard or data).
This license does not extend to third-party owned assets (including but not limited to platform-provided templates, stock icons, or default logos). ToStatic will only use assets the user has created, uploaded, or otherwise lawfully controls.
3.2. Purpose of Use
ToStatic may use the licensed assets in promotional materials, marketing communications, testimonials, case studies, and especially within a "Featured Gallery" on the ToStatic website to showcase sites successfully utilizing or interacting with the Service.
3.3. Opt-Out
If you wish to opt-out of this grant of license for your specific site assets, you must submit a written request to legal@tostatic.com with the subject line "Withdraw consent of usage of my content." ToStatic will honor the opt-out request and remove the assets within a reasonable timeframe, but this will not affect any use that occurred prior to the receipt of the request.
4. ToStatic's Rights Regarding Data and Service Management
You acknowledge and agree that ToStatic retains the following rights regarding the Service and its management:
4.1. Service Modification and Archiving
ToStatic reserves the right to, at any time and without prior notice, add, update, delete, or archive any information related to users, sites, subscriptions, features, or any other component of the Service as deemed necessary for product maintenance, development, security, or business strategy.
4.2. Account, Site, and Subscription Management
ToStatic reserves the right to suspend, terminate, or modify your account, access to sites, or subscriptions if we determine, in our sole discretion, that you are in breach of these Terms, or if required by legal or regulatory authorities.
4.3. Data Retention and Logging
ToStatic utilizes various third-party services for essential operations. You acknowledge that data, including, but not limited to, usage metrics, subscription details, and log data, may be stored or processed by these services:
Stripe: For payment processing and subscription management.
Google Analytics: For service usage analysis (tracking setup via fetch requests in the Extension background worker, so no/minimal usage of cookies).
Firestore Database: For core data storage.
Brevo: For email communications (sharing user email addresses, and basic details).
Koyeb: For API and backend service hosting.
BetterStack: For security and error logging (data may be printed in logs as part of debugging or operational checks wherein the access it limited to nominated personal only).
While ToStatic makes every effort to minimize the exposure of sensitive data, you agree that we are not liable for any incidental data exposure that is necessary for the proper functioning and debugging of the Service via these third-party tools.
4.4. Protection Against Unauthorised Access and Violations
While ToStatic implements security measures to protect its products and services from attacks and violations (including breaches of the FUP)—such as utilizing HTTPS and JSON Web Tokens (JWTs)—you acknowledge that certain oversight, technical failures, or temporary vulnerabilities may inadvertently result in a user gaining unfair or unauthorized access to our products, content, or services, or those of other users.
Liability Disclaimer: Any such unauthorised access or use constitutes a material violation of these Terms. ToStatic shall not be held responsible or liable for any resulting damages, losses, or security breaches arising from such unauthorised access or use.
ToStatic reserves the right, in its sole discretion and without notice, to immediately deny, ban, delete, or modify any such unauthorised access, requests, users, or content. We commit to actively using reasonable strategies to mitigate any such future attacks or security issues promptly. All revisions to these Terms shall apply retroactively to bind such instances of unauthorised access or use.
5. Amendments to the Terms
We may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. We will notify you of any material changes by posting the new Terms on this page or through other means of communication. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
6. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Users outside the Netherlands are responsible for ensuring compliance with their local laws when accessing or using the Service.
7. Disclaimer of Warranties
The Service, including the Extension and all content, is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. ToStatic does not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components, nor does it make any warranty as to the results that may be obtained from the use of the Service.
8. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall ToStatic or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.
In no event shall ToStatic's total liability for all claims related to the Service exceed the greater of: (i) $100 USD or (ii) the amount you paid to ToStatic, if any, in the 12 months immediately preceding the event giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless ToStatic, its affiliates, directors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms, or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right, specifically related to the content you process or extract using the Service.

10. User Responsibility and Third-Party Compliance
The Subscriber bears sole responsibility for their use of the ToStatic Service. You acknowledge and agree that ToStatic is a utility tool designed for the sole purpose of enabling users to create lawful exports of their own publicly accessible content and requires the user to affirm their legal rights to the content being exported. ToStatic does not monitor or verify whether user activity complies with third-party terms; it is the sole responsibility of the user to ensure such compliance.
Before using the Service to export content, you must: (a) confirm you are the owner or have explicit, legal permission from the owner of the content and the site's intellectual property; and (b) review and comply with the Terms of Service, Privacy Policy, and any other legal notices of the third-party website or platform you are interacting with. ToStatic makes no representations, warranties, or assurances that the Service complies with the legal terms of any third-party platform.
You assume all risk and liability for any claims, disputes, or damages arising from your non-compliance with the terms of any third-party website.
11. Copyright Complaints
ToStatic respects the intellectual property rights of others and will respond to notices of alleged copyright infringement that comply with applicable law. If you believe that your content has been used in a way that constitutes infringement, please notify us at legal@tostatic.com with sufficient detail for us to identify and remove the allegedly infringing material.
ToStatic reserves the right to remove or disable access to content alleged to be infringing without prior notice, at its sole discretion.
